IRCC Extends the Public Policy for Open Work Permit Applicants

IRCC extends its public policy in three provinces, namely Manitoba PNP, Yukon PNP and Alberta PNP. The policy, previously set to expire, has been extended until December 31, 2025. This gives eligible foreign workers more time to benefit from the program.

This highlights the extension of a federal public policy that allows foreign workers in Canada to apply for an Open Work Permit (OWP). It will only be possible if they have a support letter from a Canadian province or territory.

Open Work Permit Eligibility Criteria

To qualify for this open work permit (OWP), you must satisfy the following criteria:

• You presently hold a valid  Canada work permit and have a work permit that was valid as of May 7, 2024.
• If your work permit expires after that date, you remain eligible as long as you apply to restore your status when submitting your OWP application.
• If you were on maintained status on May 7, 2024, and have not received a negative decision on your work permit extension application, then you are eligible for it.
• You are in Canada with valid temporary resident status at the time of applying and when a decision is made on your application.

Or

• You are in Canada and plan to restore your status when you apply for the OWP.

Documentation is a crucial part of your application. The documents required are as follows:-

• A letter of employment from your current employer.
• A support letter from the province where you live and work.
• IMM 5707 Family Information form.
• A Valid passport copy.

The step-by-step process to apply for an Open Work Permit online is as follows:

Step 1: Gather the Necessary Tools and Information

To apply online, ensure you have:

• A scanner or camera to create electronic copies of your documents
• A valid credit or debit card

Step 2: Read the Instruction Guide

Review the guide thoroughly before starting your application. It provides detailed instructions on how to complete each section of the form. If your temporary resident status has expired, follow the additional steps outlined in the guide.

Step 3: Understand the Fees

Most applications include processing fees for you and any additional applicants. Fees must be paid at the end of your application. Applicable fees include:

• Work permit fee: CAD $155
• Open work permit holder fee: CAD $100
• Restoration fee: CAD $239.75

Note: Restoration fees are only paid if your status has expired.
